ADA Title III · WCAG 2.1 AA

Make your hotel website usable by every guest.

Courts increasingly treat hotel websites as places of public accommodation under the ADA—and web accessibility demand letters have become a routine cost of a non-compliant site. eMax helps you find and fix the barriers that put guests, and your property, at a disadvantage.

Why it matters

Accessibility is guest experience—and it’s a legal exposure.

Roughly one in four U.S. adults lives with a disability. If your booking flow can’t be completed with a keyboard or a screen reader, you lose the reservation and invite a claim.

Web accessibility demand letters are frequently sent in volume by a small number of plaintiffs’ firms. Hotels are common targets because booking engines, date pickers, and media-heavy pages are where accessibility barriers tend to concentrate.

Where hotel sites commonly fail

What eMax does

Real remediation—not a checkbox.

We work toward WCAG 2.1 AA, the standard most courts and settlements reference, using audits and code-level fixes rather than a single overlay script.

Accessibility audit

Automated and manual testing of your key templates and booking flow against WCAG 2.1 AA success criteria.

Code-level remediation

Fixes to markup, contrast, focus order, labels, and ARIA—so the site is genuinely usable, not just patched.

Assistive tooling

Optional visitor tools (text sizing, contrast, spacing) added as a complement to real fixes—never as a substitute.

Statement & documentation

A published accessibility statement and records of the work performed, useful if your practices are ever questioned.

Ongoing monitoring

Sites drift. We re-check after content and campaign changes so new barriers don’t quietly reappear.

Team enablement

Practical guidance so your marketing team keeps new pages, images, and PDFs accessible going forward.

An overlay can’t rewrite an inaccessible booking engine. Real compliance lives in the code. Our position on accessibility widgets
The honest version

Why an overlay alone isn’t enough.

Automated accessibility widgets promise instant compliance. In practice, they don’t fix the underlying barriers—and sites relying on them alone have still faced demand letters.

We’ll happily add assistive tooling where it genuinely helps guests, but we lead with audits and code-level remediation. That’s the difference between a site that looks compliant and one that a guest using a screen reader can actually book on.

How it works

From audit to a site everyone can use.

  1. Accessibility audit

We test your highest-traffic templates and the full booking journey, then document what fails and why.

  2. Prioritized plan

You get a plain-English report ordered by impact—what blocks guests today versus what’s cosmetic.

  3. Remediation

We implement the fixes in code and add assistive tooling only where it adds real value.

  4. Statement & records

We publish an accessibility statement and keep records of the work performed on your behalf.

  5. Monitoring

We re-check after major content or campaign changes so accessibility holds over time.

Questions

Accessibility, answered.

Does the ADA really apply to my hotel website?

Courts have widely treated the websites of public accommodations, including hotels, as subject to the ADA. Outcomes are fact-specific and the legal landscape continues to evolve, so consult qualified counsel about your situation.

What standard do you build to?

WCAG 2.1 Level AA. It isn’t a statute in itself, but it’s the technical standard most courts, settlements, and guidance reference for web accessibility.

Won’t an accessibility widget make me compliant?

On its own, no. Overlays can help some users but don’t fix underlying barriers, and sites relying only on them have still received demand letters. We lead with audits and code-level remediation.

Can eMax guarantee I won’t be sued?

No one can. Accessibility has no single certification that forecloses a claim. We help you meaningfully reduce barriers and document the work performed.

Will accessibility fixes change how my site looks?

Usually only subtly—contrast, focus states, and labels. Good accessibility and good design generally reinforce each other.

Do you provide legal advice?

No. eMax provides accessibility technology and remediation services. For legal obligations, consult qualified counsel.
